Subsidiary Numbers

Subsidiary Numbers for Commencement & Appointed Day Orders

The vast majority of Commencement Orders or Appointed Day Orders will require a commencement subsidiary number, "(C. XX)", because they commence (bring into force) the provisions of an Act of Parliament.

The main exception is where you have an amending Commencement or Appointed Day Order.  If the amendments being made do not alter which provisions are being brought into force, or when they are being brought into force, then a commencement subsidiary number would not be required.  However, if the amendments do impact on which provisions come into force, or when they do come into force, then a commencement subsidiary number would still be needed.

One other exception is that Commencement or Appointed Day Orders which commence a Code of Practice also do not require a commencement subsidiary number.

On a Commencement or Appointed Day Order which requires a commencement subsidiary number, the Department should ensure that the year and SI number placeholder is formatted as follows:

"YEAR"[space]"No."[space]"SINumber"[space]"(C.[space]SubsidiaryNumber)" e.g. "2014 No. 1234 (C. 123)"

When submitting such Orders for registration the Department also needs to ensure that the option for allocating a commencement subsidiary number is ticked.
